What happened

A bipartisan group of 18 former election officials filed an amicus brief in the Ninth Circuit case SEIU v. DOJ on November 2, 2026. The brief warned that the Trump administration's threats of criminal prosecution against state and local election officials are unprecedented and risk disenfranchising eligible voters in the midterms. The brief, filed through States United Democracy Center, argues the administration is pressuring officials to change election procedures days before voters go to the polls.1

It calls on the Ninth Circuit to protect election officials from what it describes as unwarranted federal intimidation.1
